Key Definitions
-
A Licensed Asset refers to the digital file or product purchased under a specific license agreement. This could include graphics, templates, patterns, brushes, illustrations, fonts, or other design assets available for use within the limits of the license terms.
-
An End Product is the final product you create using the licensed asset(s). This includes physical items (e.g., T-shirts, posters) or digital creations (e.g., social media graphics, websites) that incorporate the asset into a finished, non-editable design.
-
Personal use of an asset refers to using the licensed asset solely for your own personal, non-commercial purposes. This includes activities that do not involve:
- An exchange of money or other consideration.
- Promoting a business, product, or service.
- Seeking or resulting in financial gain, directly or indirectly.
For example, using a pattern to design a personal scrapbook page or creating a custom birthday card for a family member would be considered personal use. If any financial or business aspect is involved, the use qualifies as commercial and requires the appropriate license.
-
Commercial Use is any use:
- that involves an exchange of money or other consideration
- that promotes a business (e.g., sole proprietorship, corporation, or partnership), product, or service
- where financial gain or other consideration is either sought or a result, directly or indirectly, of Licensee’s use of the Licensed Asset.
If one or more of the above is true, the use is “Commercial.”
For example, designing a logo for a client, creating social media ads for a brand, or producing merchandise for sale all qualify as commercial use. Ensure you have the appropriate license for these purposes (e.g., Commercial or Extended Commercial License).
